How to check a land deed in Sri Lanka: title search, extracts and survey plan
To check a land deed in Sri Lanka, your own lawyer obtains the Land Registry extracts for the plot and traces every deed back at least 30 years, a licensed surveyor checks the land against the survey plan, and both look for mortgages, pending cases, missing heirs and reservations. Registration gives priority but does not cure a defective deed.

Step 1: Get copies of the deed and the plan from the seller
Ask for the seller's deed, any earlier deeds they hold, and the survey plan referred to in the deed's schedule (it names the plan number, the surveyor and the date). Check that the seller's name matches their national identity card, and that the land described (boundaries, extent, lot number) is the land you walked. If the seller inherited the land, ask for the probate or the deed of declaration and a list of every heir.
Step 2: Search the Land Registry extracts
Deeds are registered in volume and folio registers at the Land Registry, and each land parcel has its own folio chain. Your lawyer applies for the extracts and traces each registered deed back at least 30 years. The search should show:
- an unbroken chain from the earliest deed to the seller;
- every co-owner, so that all of them sign;
- no unreleased mortgage, lease or seizure;
- no lis pendens (registered pending case) or caveat;
- no competing deed registered for the same land in a different folio.
The registers are still largely on paper; an e-Land Registry system is being introduced. Under the Notaries (Amendment) Act No. 31 of 2022 a notary must lodge a new deed within 30 days (60 days if executed outside the notary's division), so a very recent sale may not yet appear: ask.
Step 3: Check the survey plan on the ground
A licensed surveyor prepares a fresh plan, in your presence if possible, and compares it with the plan in the deed. Look for: a different extent, boundaries that do not match fences or neighbours' walls, encroachments, a road or footpath crossing the land, and a stream, canal or coast reservation along an edge. Make sure the access road is a legal right of way shown on the plan, not just a track. The new plan becomes part of your deed or lease. Extents are in acres, roods and perches; see the perch converter.
Step 4: Check the land's status and permissions
- State land: confirm the land is private, not an LDO permit or grant. See land deed types.
- Paddy: land described as kumbura or paddy needs Agrarian Development permission before filling or building; see can you build on paddy land.
- Coast: within 300 m of the mean high water line you need a Coast Conservation permit, and a setback applies; see the coastal setback rules.
- Local authority: street line and building line certificates, and a non-vesting certificate (confirming the land is not being acquired); confirm what applies with the local authority or your lawyer.
What are the red flags in a Sri Lankan deed?
- A deed of declaration as the root of title, with no supporting evidence of long possession.
- Heirs abroad or missing, or a seller who is only one of several co-owners.
- A gap in the chain, or two deeds for the same land registered in different folios.
- A power of attorney that is old, not registered, or not authenticated if signed abroad.
- An extent in the deed that differs materially from the survey.
- Pressure to pay a large deposit before the title search is finished.
Frequently asked questions
How long does a title search take?
It depends on the registry and the land's history, so ask your lawyer for a written date before you sign anything. A clean chain on one folio is quick; inherited land, missing folios or a Bim Saviya query take longer. Our 8-step guide puts the whole purchase at six to ten weeks when title is clean. Build the time into the agreement to sell rather than skipping the search.
Can I do the title search myself?
You can visit the Land Registry, but reading folio chains, deeds of declaration and probate is specialist work, and your lawyer is also the person who will certify title and attest your deed. A search costs a small fraction of the price; see the real cost of buying land.
Does a registered deed mean the title is good?
No. Registration under the Registration of Documents Ordinance gives priority over unregistered or later deeds, but it does not cure a defect, such as a seller who did not own the whole land. That is why the 30-year chain matters. Bim Saviya title registration is different: the title register is conclusive evidence of ownership.
What is a non-vesting certificate?
A certificate from the local authority confirming that the land is not vested in, or being acquired by, the authority, for example for a road widening. Your lawyer usually obtains it with the street line and building line certificates.
Is a 30-year search a legal requirement?
It is standard practice rather than a statutory rule. Thirty years comfortably covers the 10-year period for title by prescription and normally reaches a deed of transfer that anchors the chain. The order of every step is in the 8 steps to buy land safely.
